Patent News: Samsung Won Over Apple; iPhone Maker to Pay Damages To Samsung

The latest update regarding the famous patent lawsuit between Apple and Samsung was reported and the Supreme Court decided that the Cupertino-based tech giant should pay damages to the South Korean tech company. In 2015, Samsung filed a patent lawsuit against Apple but the court ordered Galaxy phone makers to pay iPhone makers $399 million.

According to the judgment delivered by the U.S. Supreme Court, Apple will have to pay damages after breaching Samsung's patent for some of the components of a device. However, the new law states that the award must calculate the damage keeping the profit earned due to infringement. The Supreme Court stated that the exact amount of payment in lieu of damages will be decided by the lower courts, Gamenguide said. The U.S. Supreme Court has escalated the matter to the U.S. Court of Appeals for Federal Circuit which will be responsible for determining the damages.

After going through a fierce legal battle with Apple, Samsung thanked those remained loyal and supported the company throughout the proceedings. The South Korean tech giant stated that the fair decision will be a significant landmark in promoting creativity, innovation and fair competition in the fast growing and fast paced technology industry. Apple on the other hand claimed that Samsung copied their ideas intentionally and that they will protect their flagship smartphone in the future.

In 2012 on the other side, Samsung had to pay Apple in form of each unit sales after infringing 11 patents on which Samsung protected its side by stating that it will only bear the damage for infringing patents of components and not sales of devices.

Apple and Samsung are known arch rivals since 2012 until present, it started when the Cupertino-based tech giant filed a patent lawsuit against the South Korean tech company reported by Digital Trends

Apple filed the lawsuit for 11 patent infringement and stated that Samsung must pay per sales which cover the entire device and not just the infringed component. The device has over quarter million patented components and Samsung along with other supporters argued on the matter that the amount to pay as damage must be calculated on the basis of infringed component and not the entire device.

It is not the first time that patents reserved by Apple underwent copyright infringement by other brands. HTC barged into a fierce lawsuit with Apple and they settled with a cross-licensing patent deal in 2012 which is much similar to Apple Vs Microsoft patent lawsuit. Meanwhile, South Korean tech giant will receive the amount in damages after the lower courts decide the amount to be paid by Apple.
